Certain Crimes Can Be Expunged From Your Record

Bryce L CaldwellMany people believe that once you're convicted of a crime, you serve your sentence and then life returns to normal. Unfortunately, that is not always true: convictions — especially felony convictions — leave a black mark on your criminal record that has the potential to affect your life for years after your sentence is done.

Those convicted of a felony, or even in some cases a misdemeanor, may find it hard to secure a loan, find housing, and apply for jobs without expungement help from an experienced attorney. A misdemeanor domestic violence conviction at the state level is treated as a felony on the federal level in that it will prevent you from owning a firearm for the rest of your life.

Expungement Can Help You Reclaim Your Rights

Fortunately, it's possible to have certain offenses expunged, or removed, from your criminal record. Lawmakers and the judicial system increasingly recognize that one bad decision shouldn't haunt a person for the rest of his or her life. After a five-year waiting period, a wide range of misdemeanors and some felonies can be expunged.

In Kentucky it is now possible, for instance, for certain nonviolent drug-related felonies to be expunged.

For DUI charges, a compromise is available: It is possible to have a DUI expunged from your criminal record, making it easier to apply for work and other financial actions, but the charge will remain on the driving record available to police officers so that they can still track whether a driver is accruing second, third or fourth DUI offenses during the 10-year look back period from their first offense.
